Please read this Policy carefully, including without limitation any linked terms and conditions appearing or referenced below, which are hereby made part of this Policy. By participating in the referral programme, you are agreeing that you have read, and that you agree to comply with and to be bound by, the terms and conditions of this policy and all applicable laws and regulations in their entirety without limitation or qualification.
1. Poolva Referral Programme (“Referral Programme”) is where existing Poolva User ("Referrer") refer non-Poolva user ("Referee") to enrol and subscribe to the swimming lesson offered in Poolva.
2. Referrers must be existing Poolva Users to participate in the Referral Programme. Persons under the age of 18 are not eligible to participate in the Referral Programme as either Referrer or Referee.
3. Referrers may participate in this Referral Programme by providing the Referee with their unique Referral Link available upon login into Poolva. The Referrers are to follow the on-screen instructions to refer their friends and family to the Poolva Referral Programme.
4. To receive the Referral Bonus, the following conditions must be met: The Referee must successfully sign up and make a minimum of one month of swimming lessons on Poolva using the Referral Link provided. Upon successful activity, the Referrer will receive the Introductory Referral Bonus of 30% discount voucher for the next swimming lesson made through Poolva. This voucher can be stacked and redeemed with a reward tier, if applicable.
5. Each Referrer may refer up to a maximum of ten (10) Referees per month to be entitled to the Referral Bonus. Subsequent enrolment is allowed however Referrer is not entitled to the Referral Bonus until the next month's cycle.
6. Any discount voucher accrued through the Referral Bonus will be valid for one (1) year from the date on which it is granted to the Referrer’s Poolva account.
7. The participation in Referral Programme is null and void if any one of the following has been established:
(i) Referral Link is broken or tampered
(ii) Referee has an existing Poolva Account
(iii) Any fraudulent or duplicate Poolva Accounts
8. In the event the Referee has an existing Poolva Account, we reserve the right to disqualify the enrolment and any discount voucher rewarded to the Referrer as a Referral Bonus will be forfeited.
9. From time to time, Referrers may be offered special promotions with a Referral Promotion Code to be used. Such Special Promotions are valid for a limited time and will also entitle the Referrer and/or the Referee promotional Referral Bonus.
10. During Special Promotions, the Referee must enter the Referral Promotion Code during enrolment and complete a minimum of one month of swimming lessons for the Referrer to be entitled to the promotional Referral Bonus.
11. Referrers must not engage in spamming or be involved in unacceptable unauthorised practices, including creating fake accounts or harassing potential referral sources.
12. We reserve the right to disqualify any Referrers from participating in this Program at any time at our sole discretion, including without limitation if he/she does not comply with any of these Terms and Conditions. We may invalidate any potential it deems fraudulent, suspect, or in violation of these Terms.
13. By participating in the Referral Program, each participant agrees to comply with and be bound by these Terms and Conditions. We reserve the right to modify or amend at any time these Terms and Conditions and/or the methods through which the Referral Bonus is earned.
14. We reserve the right to cancel any order(s) that were made with the discount voucher for certain products that may be excluded from current promotions and any such exclusion will be notified to you through a notice on the Website or the Application.
15. All Referral Programs are subject to availability and a specified period. We reserve the right to end the Referral Programme at any time.
16. We shall not be liable for any financial loss arising out of the refusal, cancellation or withdrawal of any Referral Programme or any failure or inability of a customer to take advantage of a Referral Programme for any reason.
17. If we reasonably believe that any Referral Programme is being used unlawfully or illegally, we may reject or cancel any discount voucher and you agree that you will have no claim against us in respect of any rejection or cancellation. We reserve the right to take any further action we deem appropriate in such instances.
18. We are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunctions of our website or network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet.
19. We reserve our rights to publish or display materials or information, including but not limited to the names of all Participants for marketing, advertising and publicity purposes in any manner it deems appropriate, and participants are deemed to consent to such use with no monetary payment. By submitting your personal data, you are deemed to have consented to our Privacy Policy.
20. The terms and conditions herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Referral Programme. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version and any other version in other languages of these terms and conditions, the English version shall prevail at all times.
21. We reserve our right to vary, delete or add to any of these Terms and Conditions and/or substitute or replace the gifts from time to time without any prior notice.
22. By participating in the Referral Programme, it is deemed that the Participants agree to be bound by the terms and subject to the conditions set out herein. The decisions in relation to every aspect of the Referral Programme shall be deemed final and conclusive under any circumstances and no complaint from any Participants will be entertained.
